Introduction

Welcome to Nima. These Terms of Service govern your access to and use of the Nima mobile application and the website located at https://heynima.ai (collectively, the "App"), operated by Buzz the Goldendoodle LLC.

By downloading, accessing, or using Nima, you agree to be bound by these Terms.

Medical & Safety Disclaimer

Nima is not a healthcare provider. The content provided — including AI-generated guided meditations, ambient sounds, voice responses, and text — is for entertainment, relaxation, and self-help purposes only. It is not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or medical issue.

No professional advice. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified mental health provider.

Emergencies. If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, call your local emergency services or a crisis helpline immediately. Nima cannot provide emergency support.

Do not use while driving. Nima is designed to induce deep relaxation and sleep. Do not use while driving, operating heavy machinery, or performing tasks that require your full attention.

Artificial Intelligence & Third-Party Providers

AI technology. Nima uses AI technology from third-party partners — specifically OpenAI for text generation and ElevenLabs for audio synthesis.

Accuracy disclaimer. AI is experimental technology. It may occasionally produce content that is repetitive, irrelevant, or inaccurate. Do not rely on Nima as a source of factual information or medical advice.

No human oversight. Sessions are generated instantly by software and are not reviewed by human clinicians before delivery. You use this content at your own risk.

Service availability. Because Nima relies on third-party cloud providers, we cannot guarantee 100% uptime. If OpenAI or ElevenLabs experiences an outage, Nima may be temporarily unable to generate new sessions.

Data Storage & Account Security

To provide a seamless experience and enable history tracking, Nima stores your session history on secure cloud servers.

Your account. You are responsible for maintaining the confidentiality of your account access. Notify us immediately of any unauthorised use.

Data loss. While we implement robust security measures, no cloud service is immune to failure. We are not liable for loss of data due to technical failures, server outages, or account deletion.

Subscriptions & Payments

App Stores. All financial transactions are handled directly by the Apple App Store or Google Play Store. We do not process or store your payment information.

Refunds. Refund requests must be made directly to the platform where you made your purchase, in accordance with their refund policies. We cannot issue refunds directly.

Cancellations. You may cancel your subscription at any time via your device settings.

Intellectual Property

Our IP. The Nima brand, logo, code, visual design, and underlying AI prompt engineering are the exclusive property of Buzz The Goldendoodle LLC.

Your content. You retain full ownership of the text and journal entries you input into the Service.

License to us. By using the Service, you grant us a limited, worldwide licence to process, store, and use your content solely for the purpose of generating your sessions and providing the Service.

Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose.

Attempt to reverse-engineer, decompile, or extract the source code or AI models used by Nima.

Use the Service to harass others or generate harmful content.

Bypass or tamper with the app's security features.

Limitation of Liability

To the maximum extent permitted by applicable law, Buzz The Goldendoodle LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: personal injury or emotional distress arising from use of the content, loss of data, or service interruptions.

In no event shall our total liability to you exceed the amount you paid us for the Service in the past six months.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
